Terms of Service
Effective June 2026
These Terms of Service (the "Terms") govern your access to and use of the Talley Concierge Medicine website (the "Site") and the services made available through the Site. Please read them carefully. By using the Site you agree to be bound by these Terms together with our Privacy Notice.
1. Acceptance of Terms
By accessing, browsing, or submitting information through the Site, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced in them. If you do not agree, please do not use the Site.

References to "we," "us," "our," or "the practice" mean Talley Concierge Medicine. References to "you" or "your" mean the person accessing the Site.
3. Not Medical Advice / No Doctor-Patient Relationship Until Enrollment
The content on the Site is provided for general informational and educational purposes only. It is not medical advice, is not a substitute for professional medical evaluation, diagnosis, or treatment, and should not be relied upon to make health decisions.
Visiting the Site, reading its content, or submitting an inquiry, referral, or Free Body Composition Analysis form does not create a doctor-patient relationship between you and Dr. Talley or the practice. A doctor-patient relationship is established only after you have been formally accepted into the practice and have signed the practice's written membership agreement.
4. Medical Emergencies
The Site, the practice's online forms, and the practice's phone, text, and email channels are not for medical emergencies. If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room. Do not use the contact form, referral form, Free Body Composition Analysis form, or any other communication tool on the Site to report or seek help with an urgent or time-sensitive medical concern.
5. Eligibility
To submit any form on the Site you must be at least 18 years old and able to enter into a binding agreement under applicable law. If you are submitting information about a minor (for example, an inquiry on behalf of a child or dependent), you represent that you are the parent or legal guardian or are otherwise authorized to act on the minor's behalf.
6. Concierge Membership
Talley Concierge Medicine operates on a concierge primary-care membership model. The current annual membership fee is $2,000 for new members, billed as a rolling 12-month cycle that begins on the member's start date (not the calendar year).
The full terms of membership — including payment schedule, scope of services, eligibility requirements, after-hours access, and any cancellation, suspension, or refund terms — are set out in a separate written membership agreement provided at the time of enrollment. In the event of any conflict between these Terms and the membership agreement, the membership agreement controls.
7. Membership Fee Is Generally Non-Refundable
Except as expressly described in the membership agreement, the annual membership fee is non-refundable. The membership fee is separate from charges for medical services and is not billed to insurance.
- Multiple payment options are available, including pay-in-full, monthly installments, and CareCredit financing.
- HSA and FSA accounts are accepted.
- Insurance is still billed for covered medical services such as labs, imaging, referrals, and visits. Co-pays, deductibles, and co-insurance per your insurance plan continue to apply.
8. Insurance & Billing
Membership is not insurance. The annual membership fee covers enhanced access, extended appointments, and direct physician communication; it does not cover the cost of medical services themselves, prescriptions, hospital care, specialist care, or other services rendered by third parties.
For covered medical services performed at the practice, insurance is billed in accordance with applicable insurance contracts and the practice's standard billing practices. You remain responsible for any amount not covered by your plan, including co-pays, deductibles, co-insurance, and non-covered services. The practice does not guarantee that any particular service will be covered by your insurance.
9. Free Body Composition Analysis
The Free Body Composition Analysis is a complimentary scan offered to a limited number of new prospective patients (currently the first 20). It is provided for general wellness and educational purposes only, carries no obligation to enroll in the practice, and is not a diagnostic test. Results are not a substitute for medical evaluation. The practice may modify, limit, or discontinue this offer at any time without notice.
10. Member Referral Program
Existing members of the practice may refer a friend or family member through the referral form on the Site. If a referred individual enrolls and remains a member through the referring member's next renewal date, the referring member receives a $250 credit applied to that renewal.
- The credit applies only to the referring member's next annual renewal and has no cash value.
- The credit is not transferable, may not be combined with other promotions, and may not be redeemed for prior membership periods.
- The practice verifies each referral and reserves the right to decline credits for incomplete, duplicate, or fraudulent submissions.
- The practice may modify, suspend, or end the referral program at any time without notice.
11. Communication Tools — Acceptable Use
The practice offers active members direct physician communication via phone, text, and email, and after-hours access to the physician for urgent (non-emergency) clinical needs. These communication tools are provided to support timely, non-emergency clinical care for established members. By using them you agree to:
- Use them for your own care, or the care of a member you are authorized to assist; not for third parties.
- Not use them for medical emergencies — call 911 instead.
- Not use them to harass, threaten, defame, impersonate, or send unlawful, infringing, or unsolicited commercial content.
- Understand that communications transmitted over standard phone, text, and email may be subject to the inherent privacy and security limitations of those channels, even when the practice uses HIPAA-compliant tools where required.
The practice reserves the right to suspend or terminate access to these communication tools, and ultimately to terminate the membership in accordance with the membership agreement, for misuse.
12. Inquiry & Referral Forms
The Site includes a contact form, a referral form, and a Free Body Composition Analysis form. We collect the name, email address, phone number, communication preference, intent of the inquiry, and any free-text message you choose to share. This information is used to follow up about your inquiry. Submitting any of these forms does not create a doctor-patient relationship and does not guarantee enrollment in the practice.
Please do not submit detailed medical information, sensitive personal health information, or anything urgent through these forms. For confidential or sensitive matters, call the office at (702) 474-4110.
What the Site does and does not offer. The Site is an informational marketing site for the practice. It does not provide:
- An e-commerce checkout — no products, services, or memberships are purchased through the Site;
- A patient portal — medical records, lab results, and protected health information are not accessible through the Site;
- Online appointment scheduling — appointments and consultations are arranged by phone after the practice follows up on your inquiry.
Analytics on the Site. The Site uses Plausible Analytics only, in privacy-friendly mode. Plausible does not set cookies and does not collect personal information. The practice does not use Google Analytics, the Meta (Facebook) Pixel, advertising-network cookies, or any other cross-site tracking technology on the Site. Additional detail about data handling is in the practice's Privacy Notice.
13. Telehealth
The practice may, at its discretion, offer telehealth visits or remote check-ins to active members as part of the membership. Any telehealth interaction will be governed by a separate informed-consent document provided at the time of the visit. Telehealth is intended to supplement, not replace, in-person care, and is not appropriate for all medical concerns.
14. Intellectual Property
All content on the Site — including text, photographs, logos, illustrations, layout, design, code, and other materials — is the property of Talley Concierge Medicine or its licensors and is protected by United States and international intellectual property laws. You may view and print pages of the Site for your own personal, non-commercial use. You may not copy, reproduce, redistribute, modify, or create derivative works from this content without the practice's prior written permission.
15. User Conduct
When using the Site, you agree not to:
- Submit false, misleading, or fraudulent information through any form;
- Impersonate the practice, Dr. Talley, any staff member, or any other person;
- Scrape, crawl, or otherwise harvest information from the Site by automated means without permission;
- Reverse engineer, decompile, or attempt to derive the source code of any portion of the Site;
- Attempt to gain unauthorized access to the Site, its server infrastructure, or any related systems, or interfere with their normal operation (for example, denial-of-service attacks);
- Use the Site for any unlawful purpose or in any way that violates these Terms or applicable law.
16. Third-Party Links
The Site contains links to third-party services for your convenience, including Google Maps, the practice's Google Business Profile, and external resources that may be referenced from time to time. The practice is not responsible for the content, accuracy, availability, terms, or privacy practices of any third-party website, and inclusion of a link does not imply endorsement.
17. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Health information on the Site is general in nature, may not reflect the most recent clinical guidance, and may not apply to your particular situation. The practice does not guarantee any specific medical outcome from membership, the Free Body Composition Analysis, or any service provided.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Talley Concierge Medicine and its physicians, staff, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation lost profits, lost data, or loss of goodwill — arising out of or related to your use of, or inability to use, the Site or any content on it, even if advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for professional negligence in the provision of medical care, which is addressed separately under the membership agreement and applicable Nevada law.
19. Indemnification
You agree to defend, indemnify, and hold harmless Talley Concierge Medicine and its physicians, staff, and affiliates from and against any claims, damages, liabilities, and reasonable expenses (including attorneys' fees) arising out of or related to (a) your misuse of the Site or any communication tool offered through the Site, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
20. Termination
The practice may suspend or terminate your access to the Site (including its forms and communication tools) at any time, with or without notice, for conduct that the practice believes violates these Terms or is harmful to the practice, its members, its staff, or others. Termination of access to the Site does not, by itself, terminate any membership; membership termination is governed by the membership agreement.
21. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict-of-laws principles. Subject to the dispute-resolution section below, any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.
22. Dispute Resolution
Before filing any formal legal action arising out of or relating to these Terms or the Site, you agree to first contact the practice in writing at the address or phone number above and attempt to resolve the dispute informally. The practice will make a good-faith effort to respond within thirty (30) days.
Note for attorney review: any binding arbitration provision, class-action waiver, jury trial waiver, or limitations period shorter than Nevada's statutory default has been intentionally left out of this draft and should be added (if at all) only after counsel review, taking into account applicable Nevada and federal consumer-protection requirements for medical practices.
23. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, will be severed from these Terms, and the remaining provisions will continue in full force and effect.
24. Entire Agreement
These Terms, together with the practice's Privacy Notice, constitute the entire agreement between you and the practice regarding your use of the Site and supersede any prior agreements on that subject. The membership agreement separately governs the terms of membership in the practice, and the practice's Notice of Privacy Practices separately governs the handling of protected health information once you become a patient — each of those documents controls over these Terms with respect to its own subject matter.
25. Changes to These Terms
The practice may update these Terms from time to time. The "Effective" date at the top of the page reflects the most recent revision. Your continued use of the Site after an update constitutes acceptance of the revised Terms. For material changes, the practice will use commercially reasonable efforts to provide additional notice (for example, an on-site banner) where required by law.
